Acceptable Use Policy

This Acceptable Use Policy supplements the GlossGenius Terms of Service (“Terms of Service”) and applies to each User’s (“you” or “your”) creation of, access to, and use of the GlossGenius Services and any Account. Capitalized terms used in this Acceptable Use Policy that are not otherwise defined herein have the meanings set forth in the Terms of Service.

This Acceptable Use Policy does not create any right or private right of action on the part of any third party or any reasonable expectation that the GlossGenius Services or any Account will not contain or transmit any User Content or Communication that is prohibited by this Acceptable Use Policy. The conduct prohibited in this Acceptable Use Policy is not exhaustive.

This Acceptable Use Policy may be updated by GlossGenius from time to time upon reasonable notice, which may be provided via your Account, email, or by posting an updated version of this Acceptable Use Policy on our Site and updating the date at the top of this Acceptable Use Policy. We encourage you to review this Acceptable Use Policy periodically.

You will not, through the use of or in connection with the GlossGenius Services or any Account:

1. Engage in any conduct for an illegal or unauthorized purpose, or engage in, encourage, or promote any activity that violates the Terms of Service or this Acceptable Use Policy or that is threatening, fraudulent, or harmful to us or any other person or entity in any way.
2. As required by Communications Laws and Industry Guidelines, transmit any Communication without, (i) first obtaining the appropriate consent from each recipient, and (ii) offering each recipient the ability to revoke any consent to receive, or to opt out of receiving, future Communications from you.
3. Create, post, distribute, or transmit User Content or any Communication that:

   • Violate Communications Laws or Industry Guidelines.
   • Contain content that, in GlossGenius’s sole discretion, constitutes, endorses, promotes, or otherwise relates to sex or adult content, hate/hate speech or profanity, alcohol or alcohol-related products, firearms or weapons of any kind, tobacco or tobacco-related products, depictions of violence, gambling or contests/games of chance of any kind, counterfeit products or services, illegal or illicit drugs or any controlled substances, spam, unsolicited or bulk commercial electronic communications, chain letters, pyramid schemes or multilevel marketing, or otherwise illegal or unlawful products or services of any kind, whether pursuant to federal, state or local laws.
   • Are designed to trick, deceive, or mislead others or to impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity.
   • Contain content that, in GlossGenius’s sole discretion, constitutes, endorses, promotes, or otherwise relates to political advertisements or advertisements for medical devices or services or pharmaceutical products, without first obtaining our written approval.
   • GlossGenius, in its sole discretion, considers unfair, deceptive, or predatory towards another person or entity.
4. Market, offer for sale, or sell services and products containing CBD, THC, ketamine, or any other illegal, illicit, or controlled substance.
5. Violate the rights of others, including others’ copyrights, rights of publicity, or other intellectual property rights.
6. Discriminate against people based on any federal, state or locally protected classes including, but not limited to, their race, color, national or ethnic origin, religion, age, sex, gender, sexual orientation or preference, or physical ability.
7. Engage in any harassing, threatening, intimidating, predatory, or stalking conduct.
8. Transmit code, files, scripts, agents, or programs intended to do harm, including viruses or malware, or using automated means, such as bots, to gain access to or use of the GlossGenius Services or any Account.
9. Engage in processing (where there is no bona fide good or service sold or donation accepted), card testing, evasion of card network chargeback monitoring programs, or sharing cardholder information with another merchant for payment to cross-sell products or services.
10. Encumber any Account with liens, nor use any Account or any future receivables related with such Account as collateral for a lien including, but not limited to, entering into a Uniform Commercial Code lien for such purposes.
11. Reverse engineer any aspect of the GlossGenius Services or do anything that might discover or reveal source code, or bypass or circumvent (i) measures employed to prevent or limit access to or use of any part of the GlossGenius Services or any Account, or (ii) restrictions aimed at deterring or preventing uses of the GlossGenius Services or any Account that violate this Acceptable Use Policy;
12. Develop or use any applications or software that interact with the GlossGenius Services or any Account without our prior, written authorization.
13. Research or develop products, models, or services that compete with GlossGenius.
14. Sell or resell the GlossGenius Services.
15. Use any data mining, robots, or similar data gathering or extraction methods designed to scrape or extract data from the GlossGenius Services or any Account, except in accordance with instructions contained in our robots.txt file and then only to compile for search results.
16. Modify the GlossGenius Services, remove any proprietary rights notices or markings associated with the GlossGenius Services or any Account, or otherwise make any derivative works based upon the GlossGenius Services.
17. Use or access or attempt to use or access another User’s Account or information without authorization from that User and GlossGenius.
18. Use the GlossGenius Services or any Account in any manner that could interfere with, disrupt, negatively affect, or inhibit other Users from fully enjoying the GlossGenius Services or any Account or that could damage, disable, overburden, or impair the functioning of the GlossGenius Services or any Account in any manner.
19. Use the GlossGenius Services or any Account if you are not eligible to use the GlossGenius Services or any Account in accordance with the Terms of Service.
20. Use the GlossGenius Services or any Account other than for their intended purpose.
